Neighbor Draining Water onto My Land?
First of all, I live in Wisconsin. My neighbor has a pond that apparently has been overflowing recently and he has hooked up a sump pump with the hose aimed toward my land, but it is technically draining onto his land and eventually ending up on my land, which in turn is causing major flooding in my front yard and is submerging my electric box for my land.
I have gone over to my neighbor’s house and very politely asked him to move the hose somewhere else, but all I got in response was a very nasty “I’m not moving it because I don’t want my basement to flood”. He was not even willing to drain it into his ditch in the front of his yard, which is obviously hooked up to the sewer system. He definitely knows exactly what he is doing to our land.
I have looked up the Wisconsin Water Laws and I found something in Wis. Stat. 88 but it seems to be talking about just agricultural land. Would this still be something that I could go talk to the township or city hall about?
If his actions are causing damage to your property, you have grounds for a civil suit. You’ll need evidence. I suggest you make videos and take photos. Get some impartial witnesses. Document everything. Keep a log of all activities by both parties.
