Legal question regarding a lease?

I recently got into a basement apartment paid the rent and deposit, I signed the 6 month lease my wife did not sign. We slept there one night and moved out the next day cause the place sucked, holes in the floors, ceilings were not finished and lights did not work, lots of spiders. The landlord said he would give us our money back, I told him to keep one weeks rent for the trouble. He now is avoiding us at all costs to give us our money. What can we do? what would the law say? etc…

You may have a legitimate claim: the premises were unfit for habitation, and you have the agreement of the landlord (you say) to waive any penalties on the lease. However, you must act quickly to document the situation in writing. Send landlord a memo that outlines your facts, and remind him that he agreed to waive the lease. Make it very clear that you have now given notice of termination, which he has accepted without penalties. Worst case, he can charge you for a month (possibly more), after which it was his duty to find a new tenant.
